BC CANCER FOUNDATION COMMUNITY FUNDRAISER RELEASE OF LIABILITY, WAIVER OF CLAIMS, ACKNOWLEDGMENT AND ASSUMPTION OF RISKS, INDEMNITY AGREEMENT And MEDIA CONSENT

As a community fundraiser supporting the BC Cancer Foundation, I acknowledge the following:

1. This is an independent fundraising initiative benefitting the BC Cancer Foundation.
2. My participation in the fundraising initiative is voluntary.
3. It is the responsibility of each participant to:
   • Ensure they consider and understand the risks, dangers, hazards and the possibility of personal injury resulting therefrom associated with all fundraising activities,
   • Determine, taking into consideration those risks and the participants behavioural characteristics and physical health and abilities, whether they should participate in the said fundraising activities,
   • Consult with a physician, if necessary, to ensure fundraising activities align with personal preference and ability, and
   • Complete fundraising activities based on personal preference and capability (pace, cadence, aerobic threshold)
4. In consideration of my participation in the fundraising initiative, I:
   • accept and fully assume all risks associated with my fundraising activities and will not hold the BC Cancer Foundation liable for any personal injury, death, property damage, or loss resulting there from.
   • agree to waive any and all claims that I have or may in the future have against the BC Cancer Foundation, and to release the BC Cancer Foundation from any and all liability for any loss, damage, expense, or injury including death that I may suffer, or that my next of kin may suffer, because of my fundraising activities.
   • agree to hold harmless and indemnify the BC Cancer Foundation from any and all liability for any damage to the property of or personal injury to any third party, resulting from my fundraising activities.
5. This release shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns and representatives, in the event of my death or incapacity.
6. I agree to:
   • abide by the local, provincial, and federal regulations and bylaws that are in place during my fundraising activities. It is my responsibility to ensure that I understand and adhere to these regulations and to seek all necessary licences and permits that may be needed.
   • conduct my fundraising in accordance with CRA Guidelines and the rules set out by BC Gaming (where applicable), and I recognize that it is my responsibility to ensure that I understand those rules and procedures which apply to my fundraising activities.
7. I am not an agent of the BC Cancer Foundation and will receive no compensation from the Foundation for my fundraising activities.
8. By submitting any photo, video, information, or promotional materials to the BC Cancer Foundation in connection with my fundraising activities, I agree that I own any such materials and have obtained consent from all identifiable parties in any such materials to submit them to the BC Cancer Foundation. Any such materials submitted may be used by the BC Cancer Foundation to recognize the support of my fundraising activities and/or to promote community fundraising in support of the Foundation.
9. I am at least 19 years of age at the time of completing this Release. I understand that I am responsible for the wellbeing of youth under the age of 19 who may participate in the fundraising activities planned under this Release and that I will take reasonable steps to ensure the do so safely.
